Stories from people who resolved labor and workers' comp issues with Sobaek.

  • Workers' comp claim

    Fall at a construction site

My company wanted a company-paid settlement outside workers' comp ("gongsang"), and I went back and forth for a few days before I called. Once I heard what happens with gongsang if treatment drags on, I went with workers' comp. I got the site photos and a statement from an older guy I worked with, and the attorney reviewed the paperwork. Approval came through in about two months. It got kind of annoying when the Korea Workers' Compensation and Welfare Service (KCOMWEL), the government agency that decides workers' comp claims, kept asking for more documents, but every time he told me right away exactly what to send, so that part was easy

  • Occupational disease

    Rotator cuff tear, manufacturing worker

Got approved. I'd worked on the line for over 20 years before I had shoulder surgery, and I figured my age would sink the claim. But in the consultation he asked about my work in a lot of detail and said let's start by gathering evidence. Filming my work and pulling together the process charts was a hassle, honestly. What reassured me most was that he came with me the day I gave my statement to the Occupational Disease Adjudication Committee. Took five months to get a decision.

  • Workplace accidents

Delivery rider crash on the job

I got into a crash while making a delivery and was only thinking about car insurance, but a friend said workers' comp might cover it too, so I reached out. I sent screenshots of that day's delivery log and order history from the app, and they laid out whether to go with the insurance company or workers' comp first. Sometimes they can't pick up the phone right away, so I left a KakaoTalk message, and I got a reply the same day. I bet a lot of riders like me just let it go because they think workers' comp doesn't cover us

  • Cerebrovascular/cardiovascular

Brain hemorrhage on the night shift

My husband collapsed on the night shift, and I reached out while he was in the ICU. The hardest part was that his company wouldn't hand over his work records, but they told me exactly what to request and how, and when I did that, we got them. It wasn't until I saw several months of his hours laid out that I understood why it counted as workers' comp. It's been approved and he's getting treatment now. I called a bunch of times while everything was chaotic, and they picked up every time. I'm really grateful

  • Permanent disability benefits

Request for review of a disability grade

I hurt my finger and got a low disability grade, and I almost just accepted it before I came in for a consultation. They said an item that should have been on my medical certificate was missing and explained which test I needed, so I went back to the hospital and got it done. About three months to get a decision on the request for review. My grade was adjusted. Honestly, the cost was a stretch for me, but on my own I wouldn't even have known what to get redone, so no regrets

Frequently asked questions

Your workers' comp and employment questions, answered by Sobaek

Can I get a consultation to find out whether my situation qualifies for workers' comp?

Yes. To start, it helps to have your medical certificate and medical records (imaging reports and test results) ready so we can tell whether your case is an accident or an illness. For an accident, we'll ask detailed questions about what happened. For an illness, depending on the type, we'll ask about how it was diagnosed and your current condition, your past work history, your job duties, and other details.

Can I file for workers' comp if my employer won't cooperate?

Yes. Workers can file a claim for medical care benefits without the employer's seal or cooperation. That said, in some cases, depending on the type of case and your situation, the employer's cooperation matters a lot, so we'll need to review the facts.

Can you still help if my workers' comp claim was already denied?

Yes. You can challenge the denial within 90 days of the denial decision (the decision date) by filing a request for review with KCOMWEL or a request for reconsideration with the Industrial Accident Compensation Insurance Reconsideration Committee.

What does a labor attorney actually do for me?

For a workplace accident, we look into everything from the facts of the case to any legal violations by the employer, so you're not at a disadvantage in a later dispute. That matters because if you're considering employer's liability insurance, auto insurance, or a damages claim after your workers' comp case closes, the case has to be handled with each party's share of fault in mind. For an occupational disease, we start by investigating what's needed to assess work-relatedness, such as your work history, job duties, and medical condition. We follow the guidelines of KCOMWEL, so it doesn't make arbitrary findings about the facts of your case, and we help you get work-relatedness recognized by the Occupational Disease Adjudication Committee.

What should I prepare for my first consultation?

Don't overthink it. Even if you don't have any documents, just give us a call or leave a consultation note. We'll get a sense of your situation and tell you what you need, and there's still time to gather documents after that.

Can I get a consultation by phone instead of coming in?

It's a good idea to start with a phone consultation to see whether your workers' comp or unfair dismissal claim is likely to be accepted. If it isn't, we'll think hard about the best realistic alternative and walk you through it. We won't push you to file anything you don't need.

How much does a consultation cost, and what are your fees for taking a case?

Your first consultation is free. Fees depend on the type and complexity of the case, so we'll need to talk with you first.

Can I also get help with unfair dismissal, unpaid wages, or workplace harassment?

Yes. Sobaek Labor Law Office focuses on labor and workers' comp cases.
