Average wage correction
If your workers' comp benefits came in lower than expected, check your average wage first.
If you're a day laborer, we check whether your daily wage was counted correctly. If you're paid monthly, we look for missing allowances or bonuses. We also check whether the calculation period and any special rules were applied correctly. We handle the average wage correction request and the resulting claim for the benefit difference on your behalf.

What is an average wage correction?
Your average wage is the basis for calculating temporary disability (lost-wage) benefits, permanent disability benefits, survivors' benefits, and more. When the wages, period, or method used by KCOMWEL, contain an error, an average wage correction is the process for fixing it. KCOMWEL won't correct your average wage on its own until you file a request. Basic formula: total wages for the 3 months before the date the calculation event occurred ÷ total number of days in that period

What we review for correction
We check for bonuses and allowances left out of your average wage, and for an incorrect calculation period.
Missing bonuses and allowances
We check whether bonuses, overtime and night work pay, and annual leave pay count as wages, and which period's amounts belong in the calculation. We don't include or exclude a full amount based on its name alone.
Wrong reference date or calculation period
We check whether the date of the calculation event, the 3-month window before it, and the total number of days are correct.
Calculations for day laborers and daily-wage workers
We review whether the calculation matches the daily wage you were actually paid, and whether applying the ordinary employment coefficient (0.73) is appropriate.
Occupational disease diagnosed after leaving the job
We check whether the special average wage rule for occupational disease applies, and which wage records and point in time the calculation should use.
Ordinary wages and wage adjustments
We check the statutory rule that supplements the average wage with ordinary wages, and whether average wage adjustments and the timing for each benefit were applied correctly.
Records needed for recalculation
We compare KCOMWEL's average wage calculation with your actual wage records.
We identify which deposits count as wages, confirm which periods to include and exclude, and recalculate your average wage.

Correction vs. difference claim
We prepare the average wage correction and the benefit difference claim together.
A change in your average wage can affect how much you receive in temporary disability (lost-wage) benefits, permanent disability benefits, and survivors' benefits. After we fix missing wages, calculation period errors, and how special rules were applied, we calculate which benefits are affected and for which periods. Along with the average wage correction, we prepare a difference claim for each benefit. The statute of limitations for each benefit and the appeal deadline for the original decision each need to be checked separately.
Sobaek's practice areas
We correct a miscalculated average wage and claim the benefits you were underpaid.
- STEP 01

Review the existing calculation
We compare KCOMWEL's calculation sheet with your actual wage and work records to find missing items, period errors, and whether special rules were applied.
- STEP 02

File the correction request and difference claim
We submit the grounds for correction and the recalculated figures, and claim the benefit difference that results from the corrected average wage.
- STEP 03

Respond to a refusal or a dispute over the difference
If KCOMWEL refuses the correction or doesn't accept the difference you claimed, we review the reasons and the filing deadline, then challenge the amounts and calculation basis you disagree with.
Frequently asked questions
Find answers to your questions before a consultation.
I was paid by the day. Can I just divide by the number of days I actually worked?
Dividing only by the days you actually worked may not give you an accurate average wage. The total number of days in the calculation period, your type of work, and the special rule for day laborers all need to be checked.
Do bonuses and annual leave pay all count toward my average wage?
We check whether each item counts as wages, which period it belongs to, and how much should be included. We don't include or exclude a full amount based only on its name or the date it was deposited.
Can I still get a correction if the company closed or I don't have pay stubs?
Missing records alone don't settle the question. We check whether bank records, tax withholding records, an employment contract, or other documents can prove your wages and employment. If your deposits include expense reimbursements or other money, the portion that counts as wages has to be calculated separately.
I left the job long ago and my pay was low back then. Is my compensation based only on that amount?
We need to check whether the special average wage rule for occupational disease or the wage adjustment rules apply. Not every former employee qualifies for the same special rule. It depends on the illness, your work history, and the calculation date.
I already received my permanent disability benefits as a lump sum. Can I still request a correction?
Even after payment, we can look at whether there was a calculation error and whether you can claim the difference. The payment date, the original decision, and the statute of limitations all need to be reviewed separately, so please have your decision notice and payment history ready.
If my average wage is corrected, will I get more for every benefit I've already received?
Not necessarily. We need to check which benefits and payments the correction affects, along with the statute of limitations. Some benefits may show no actual difference.
I don't know what average wage KCOMWEL used. What should I bring?
Start with whatever benefit decision and payment records you have. Once we confirm the calculation details and compare them with your actual wage records, we can tell whether anything needs to be corrected.
